1. Purpose
These General Conditions (hereinafter the “General Conditions” or “GTC”) aim to define the terms and conditions for providing the monthly or quarterly subscription service (hereinafter the “Subscription” or “Service”) offered on the website www.boutik-prive.fr (hereinafter the “Site”), as well as to define the rights and obligations of the parties in this context.

The Service consists of providing exclusive discounts on a selection of high-demand products (hereinafter: the “Service”); this Service is billed via a Subscription charged on a monthly or quarterly basis. The subscriber (hereinafter: the “Subscriber”), by logging into their member area, will have access to the product catalog with exclusive discounts reserved for them.

These General Conditions are available at any time via a direct link on all pages of the Site.
Use of the Site or any of its features implies the express, prior, full and complete acceptance of these general terms of use by the Subscriber.

1.1 Scope of application of the General Conditions of Sale
These GTC apply to any Subscription made on the Site. The GTC are exclusively applicable to consumers established in mainland France. The GTC, as well as all contractual information mentioned on the Site, are written in French. Online acceptance of these GTC is materialized by a mandatory checkbox.

1.2 Availability and enforceability of the General Conditions of Sale
The GTC are made available to customers or communicated before the contract is definitively formed. The GTC are made available to consumers on the Site via the hypertext link “terms and conditions,” where they can be directly consulted. The GTC are enforceable against the user who acknowledges, by checking a box provided for this purpose, having read them and accepted them before subscribing to the Subscription. Any Subscription implies the Subscriber’s adherence to the GTC in force on the day of the order.

1.3 Modification of the General Conditions of Sale
These GTC may be modified. The Company reserves the right to modify its GTC at any time.

In the event of modifications, the Subscriber will be informed by email at the address provided at the time of Subscription, 15 days before the new General Conditions come into force. They will then have the possibility, if they do not consent to these new GTC, to terminate their Subscription under the conditions provided in the “Termination” article.
Termination of the Service by the Subscriber will be effective at the end of the current period and will not give rise to a refund for the current month.

2. Subscription to the Service
a. Conditions
To subscribe to a Subscription, the Site User (hereinafter the “User”) certifies on their honor that they are of legal age and legally responsible under the laws in force in France. They guarantee that they can legally enter into a binding contract and reside in mainland France.

b. How to subscribe?
To subscribe to the Service, the User must validate the GTC via the checkbox provided for this purpose, complete the payment form, and confirm the subscription. In the event of communication of erroneous or incomplete data, the Company cannot be held liable.
The User guarantees that all information provided in the form is accurate, up to date, and sincere, and is not misleading.
The Subscriber undertakes to inform the Company at the address mentioned in Article 1 or by email at contact@boutik-prive.fr in the event of changes to their contact details (notably: change of address).
The Subscriber is informed and accepts that the information entered for the purpose of creating or updating their Account constitutes proof of their identity. The information entered binds them upon validation. The Company reserves the right to verify the accuracy of the data provided.

At the end of registration, and after payment of the price of the Service in accordance with Article 7, the Subscriber receives a confirmation email of their Subscription.

3. Description of the offer

3.1 The Boutik-Prive offer
To subscribe to boutik-prive.fr, customers must go to the Site www.boutik-prive.fr or to one of the Site’s pages offering a welcome offer.
Boutik-Prive offers all its Subscribers the opportunity to discover each month a selection of products with exclusive discounts. The products offered correspond to high-demand products.
WARNING: IF NO PURCHASE IS MADE DURING THE MONTH, THE SUBSCRIBER WILL STILL BE CHARGED THE SUBSCRIPTION.
The Subscriber may place as many orders as they wish throughout the duration of their subscription.

3.2 “Welcome offers”
Boutik-Prive regularly offers “Welcome Offers” as part of its commercial policy. These offers, reserved for new members, allow subscription to the Service while benefiting, on the one hand, from a cash-back refund of €80 for only €1 and, on the other hand, from a discovery access to the website for a duration of 72 hours, at the end of which, and in the absence of termination by the Subscriber, the Subscription of €29.90 (or €75 per quarter) will automatically take effect.

How does the boutik-prive.fr welcome offer work?
When you subscribe to a boutik-prive.fr subscription, you automatically benefit from a 72-hour discovery period billed at only €1 as well as a welcome offer for an €80 refund. To benefit from this offer, you must purchase the product indicated in the promotional offer, send the invoice to contact@boutik-prive.fr, and you will receive the refund within 30 days to the PayPal account associated with your email.
Limited offer: you have 30 days to send proof of purchase and benefit from your €80 refund.

At the end of this 72-hour period, and if you have not informed us of your wish to unsubscribe, your subscription will be confirmed and you will be charged (€29.90/month or €75/quarter).
The conditions of the Subscription are stipulated in Article 7 specifying the price and payment terms. As part of this offer, the Service begins 72 hours following confirmation of the Subscription.

4. Access to the Site
Access to the Site is possible 24 hours a day, 7 days a week, except in cases of force majeure or events beyond the control of the Company, and subject to any breakdowns and maintenance interventions necessary for its proper functioning.
The Subscriber is solely responsible for setting up the computer and telecommunications resources enabling access to the Site. They bear the costs of telecommunications and internet access for using the Site.

5. Characteristics of the Service and Products
The Service consists of providing exclusive discounts each month on a selection of high-demand products. The Subscriber may benefit from the Service subject to proper collection of the Service price in accordance with Article 7 and subject to placing an order each month.
The products offered each month vary. The Company endeavors to offer a wide variety of trendy products with exclusive discounts and no delivery charges.
Photographs and descriptions of Products appearing on the Site are not contractual.

6. Duration of the Service
The Subscription is entered into for a period of one month and then renewed by tacit renewal for successive periods of one month, with the possibility for the Subscriber to unsubscribe at any time and for any reason, under the conditions provided in Article 9, or to withdraw within 14 days after their subscription in accordance with the conditions provided in Article 10.

7. Price and payment terms

a. Price
The price of the subscription to boutik-prive.fr is €29.90 including tax per month (or €75 per quarter). Invoices are available in the member area of the boutik-prive.fr Site under the section “My subscription.”

b. Payment terms
The Subscriber must provide a valid bank card to subscribe to the Site. The bank card will be charged €29.90 each month (or €75 per quarter) until the Subscriber wishes to terminate their Subscription.

The charge for the Service price is carried out by secure online payment service providers to whom boutik-prive.fr subcontracts the implementation of payment, and who alone retain the Subscriber’s banking details for this purpose.
boutik-prive.fr does not retain any banking details and cannot consult or modify them.
The Subscriber guarantees to boutik-prive.fr that they have the necessary authorizations to pay the price of the Service according to the terms provided in this article.
During the duration of their Subscription, the Subscriber undertakes to take the necessary measures so that the automatic debit of the monthly or quarterly price of the Service can be carried out.
boutik-prive.fr reserves the right to suspend or cancel delivery of the Product and/or terminate the Subscription in the event of non-payment of any sum due by the Subscriber, in the event of a payment incident, or in the event of fraud or attempted fraud relating to use of the Service.

8. Delivery
Product deliveries are made to the delivery address indicated by the Subscriber when subscribing to their subscription.
Deliveries are made by postal shipment, within a maximum period of 30 days following validation of the order by the Subscriber under the conditions provided in Article 3.

If the Subscriber does not receive the ordered Product within this period, they may contact Boutik-Prive at the postal details mentioned in Article 1 or by email: contact@boutik-prive.fr. The Company will take all appropriate measures to search for the lost Product and, upon confirmation of this loss, will resend the Product to the Subscriber within a reasonable period.

In the absence of delivery within a reasonable time following notification by the Subscriber of the delivery delay, the Subscriber may also request, by registered letter with acknowledgment of receipt or by email, termination of the contract.
The Subscriber will then be fully refunded for the last payment in progress.

9. Suspension of the contract

a. At the Subscriber’s initiative
The Subscriber may terminate their Subscription to the Service at any time without having to justify their decision.
Unsubscription may be carried out online via the Site www.boutik-prive.fr or by making a request to customer service either:

  • by telephone at 01 76 40 25 18, Monday to Friday (09:00 to 18:00)

  • by using the online form accessible here: retraction form

If the Subscriber unsubscribes while the automatic debit of the Service is in progress or has already been made, they may access the shop and benefit from exclusive discounts until the end of the validity of the current subscription.
The Subscriber retains in all cases the possibility of returning the Product to Boutik-Prive; to do so, they must contact customer service in order to learn the return procedures and any delivery costs. Refund of this shipment will be made after receipt and verification of the package.

b. At the initiative of Boutik-Prive
Boutik-Prive reserves the right to terminate the Service at any time in the event of non-compliance by the Subscriber with these General Conditions, notably Article 7.
Boutik-Prive also reserves the right to stop offering the Service. Termination of the Service will be communicated to the Subscriber by any appropriate means.

10. Right of withdrawal
In accordance with the provisions of the Consumer Code applicable to distance selling, the Subscriber has a withdrawal period of fourteen (14) clear days from the date of their subscription.
The Subscriber must submit their request via the withdrawal form accessible here.
They may exercise this right within 14 clear days from their Subscription.
Return costs shall be borne by the Client.
The Product must be returned to Boutik-Prive in its original packaging.
The Subscriber will be refunded the price of the Service corresponding to the returned Product as soon as possible and at the latest within 14 days following the withdrawal date.

11. Warranties
The Subscriber benefits from the legal warranties of conformity as well as from hidden defects of the item sold as defined in Articles L217-4 to L217-14 of the Consumer Code and Articles 1641 to 1649 of the Civil Code.
If the Subscriber finds that the delivered Product has a defect, a lack of conformity, or is damaged, they may return it to Boutik-Prive according to the procedures described below.

The Subscriber must contact Boutik-Prive customer service by email at contact@boutik-prive.fr, specifying the nature of the defect, lack of conformity, or damage observed.
Boutik-Prive will indicate the return procedures. Boutik-Prive will carry out the necessary checks and proceed with replacement of the Product.
If replacement of the Product is impossible, Boutik-Prive reserves the right to send the Subscriber another Product of equivalent value, with the Subscriber benefiting from the right of withdrawal provided for in Article 10 for this other Product.
The buyer may decide to invoke the warranty against hidden defects of the item sold within the meaning of Article 1641 of the Civil Code. In this case, they may choose between cancellation of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.

12. Liability
The Company undertakes to carry out regular checks to verify the functioning and accessibility of the Site. In this respect, it reserves the right to temporarily interrupt access to its sites for maintenance reasons. Likewise, the Company cannot be held liable for temporary difficulties or impossibilities of access to these sites resulting from circumstances beyond its control, force majeure, or disturbances of the telecommunications network, the Subscriber being informed of the complexity of global networks and the influx of internet users at certain times.
Furthermore, Boutik-Prive cannot be held liable for non-performance or delay in performance of the contract due to a case of force majeure.

13. Intellectual property
The systems, software, structures, infrastructures, databases, and content (texts, images, visuals, music, logos, trademarks, etc.) operated by Boutik-Prive as part of the Service are protected by all applicable intellectual property rights. Any disassembly, decompilation, decryption, extraction, reuse, copying, and more generally, any acts of reproduction, representation, distribution, and use of any of these elements, in whole or in part, without authorization from Boutik-Prive, are strictly prohibited and may give rise to legal proceedings.

14. Personal and banking data
The Company collects, during the Subscriber’s registration, personal data concerning their contact details (e.g., telephone number, last name, first name, postal address, email, etc.).
If Site visitors decide not to finalize the Subscription process, the Company only collects the email address.
The Company collects this information only for persons who have ultimately chosen to subscribe to a Site Subscription.
This collection allows the Company to send the Subscriber their order, improve the services offered to its Subscribers, and communicate information about these services and new offers.
By subscribing to the Subscription, the Subscriber accepts the processing of their personal data for the purposes of managing Subscriptions and providing the Site’s Services.
In accordance with the provisions of Law No. 78-17 known as the Data Protection Act of January 6, 1978, and EU Regulation 2016/679 applicable since May 25, 2018, Law 2018-493 of June 20, 2018 relating to the protection of personal data, the Subscriber has the right to obtain, erase, object to, access, rectify, and delete all personal data concerning them obtained by the Company during use of the Service. 15. Prohibited behaviors
The following are strictly prohibited:
(i) any behavior likely to interrupt, suspend, slow down, or prevent continuity of the Service,
(ii) any intrusion or attempted intrusion into Boutik-Prive systems,
(iii) any misappropriation of the Site’s system resources,
(iv) any action likely to impose a disproportionate load on its infrastructures,
(v) any breach of security and authentication measures,
(vi) any act likely to infringe the financial, commercial, or moral rights and interests of Boutik-Prive or the users of its Site, and more generally,
(vii) any breach of these general conditions.

In the event of breach of any provision of this paragraph or, more generally, of violations of laws and regulations, Boutik-Prive reserves the right to take all appropriate measures and to initiate any legal action.

16. Advertising
Boutik-Prive reserves the right to insert on any page of the Site any advertising or promotional message in a form and under conditions solely determined by Boutik-Prive. More generally, the Subscriber declares being informed that Boutik-Prive may broadcast any advertising and promotional content on the Site.

17. Written communications
Applicable regulations require that certain information or communications be transmitted in writing. By using this Site, the Subscriber accepts that these communications be made primarily by electronic means.
For contractual reasons, the Subscriber accepts this electronic means of communication and acknowledges that all contracts, notices, information, and other communications provided by the Site electronically comply with legal requirements that such communications be made in writing.

18. Applicable law and jurisdiction
With regard to disputes between the Company and the Subscriber concerning the Subscription, the Subscriber is invited to attempt to resolve the dispute amicably before referring the matter to the courts, by contacting the Company’s customer service as soon as possible at the following email address: contact@boutik-prive.fr or by telephone.
In the event of a dispute relating to a Subscription, the Client must first submit their complaint to customer service in order to seek an amicable solution, either:
